Terms of Service
Effective October 9, 2026
These terms are an agreement between you and Better Swag (“Better Swag”, “we”, “us”), which operates GTM Swag at gtmswag.com. They apply when you create an account, use a workspace, or connect GTM Swag to another tool through our API, an API key or an AI assistant. If you use GTM Swag for a company, you agree for that company and confirm that you are authorized to do so.
1. The service
GTM Swag helps businesses choose, personalize, pay for and track physical gifts for prospects, customers and other business contacts in the United States. You can browse the gift catalog, build campaigns, add recipients by hand, by CSV upload, through the API or through a connected AI assistant, and review the total before paying. Depending on the campaign, a gift ships to an address you provide, or the recipient confirms their own address through a private gift link that you share through your own outreach. GTM Swag does not email your prospects for you. Better Swag staff review, produce and ship each order.
GTM Swag is a business service. It is not intended for personal, family or household purchases, and it is not directed to children.
2. Accounts and workspaces
- You sign in with Google or with a one-time code sent to your email address. GTM Swag does not use passwords. Keep access to your email account secure and never share a sign-in code.
- Your account belongs to a workspace for your company. Workspace owners and admins can invite and remove teammates and manage integrations. Each workspace is responsible for everything done by its members, its API keys and its connected tools.
- Give us accurate information, keep it up to date, and tell us promptly at eric@betterswag.com if you believe your account, an API key or a connection has been misused. You can revoke keys and connections yourself at any time.
- You must be at least 18 years old to create an account.
3. Your responsibilities for recipient information
You decide whom to send a gift to and what information about them you give us, such as names, work email addresses, companies, job titles, LinkedIn or other profile URLs, postal addresses, photos, notes, research context and columns from your own files. You are responsible for that information. In particular, you confirm that:
- you have a lawful basis, and any notice or permission the law requires, to collect the information and to share it with us so that we can prepare and deliver the gift;
- you give us only what is needed for the gift, and you do not upload sensitive information such as health details, government ID numbers or financial account numbers;
- you have the right to use any photo, logo or artwork you provide or approve. When you ask us to find a photo, we use only an image you are permitted to use, you approve the exact image, and you confirm that you have permission before it is printed;
- you will honor a recipient’s request to stop, including when they decline a gift.
4. Responsible gifting
- No spam or harassment. When you share a gift link or follow up with a recipient, you are the sender of that message. You are responsible for complying with anti-spam and marketing laws and with the rules of the platforms you use.
- Gift and anti-bribery rules. You must comply with anti-bribery and anti-corruption laws, and with any gift limits that apply to you or to the recipient, including rules for government officials and the recipient’s employer policies. Do not use a gift to improperly influence a business decision.
- No strings attached. A gift must never be conditional on a meeting, a reply, a purchase or any other action. Recipients are always free to accept or decline.
- Alcohol and restricted items. Alcohol may be sent only where we support it, only to recipients you have confirmed are at least 21 years old, and only by carriers that require an adult signature on delivery. You must also confirm that the recipient’s workplace gift policies allow it. For food gifts, consider allergies and dietary needs.
5. Human review and payment
A person stays in control of every purchase. API keys, the MCP server, and AI assistants such as ChatGPT and Claude can search gifts, prepare drafts, add recipients and retrieve information your connection is permitted to see. They cannot approve spending, pay, add funds, or change approval rules. A teammate signed in to GTM Swag reviews each campaign, and an owner or admin approves payment in the browser. An owner or admin may instead turn on auto-approve for an always-on playbook, with a per-gift limit and a monthly budget. Gifts within those limits are then paid from your prepaid balance without a separate review, and anything outside them waits for a person. Our staff also review each order before production, including the shipping address, the supplier and any personalization. We may ask you to correct or confirm details before we proceed.
6. Pricing, taxes and payment
- Prices are in US dollars. The total you review and approve is an all-in amount for the gift, delivery and applicable sales tax, which is calculated within that amount rather than added on top. If a price must increase, we ask you to approve a new quote first.
- Payments are processed by Stripe through its hosted checkout. We do not receive or store your full card details. Stripe’s own terms and privacy policy also apply to your payment.
- For prepaid campaigns, you pay a fixed amount per recipient before gift links can be used. Always-on playbooks are paid from a prepaid workspace balance that an owner or admin adds funds to. Cancelled or declined gifts are credited back to that balance. Recipients never pay.
- Catalog descriptions, photos and lead times are provided in good faith. A product may become unavailable. If we cannot fulfill a paid gift, we will tell you and refund it.
7. Production and delivery
- We deliver only to addresses in the United States.
- Better Swag staff place each reviewed, paid order with the supplier that produces the gift and arrange shipment with a carrier. Delivery dates and lead times are estimates, not guarantees, and can be affected by suppliers, carriers, weather and holidays.
- Personalized gifts are made for a specific recipient. Check names, notes, photos and artwork carefully before you approve them, because they cannot be changed once production starts.
- We may decline or cancel an order that we cannot fulfill safely, lawfully or as described. If you have paid for it, we refund it.
8. Private gift links
A gift link is a private URL that shows one recipient a message from you and lets them confirm a US shipping address or decline the gift. Anyone who has the link can open it, so share it only with the intended recipient. Links expire 14 days after they are created, and viewing or exporting a link does not extend it. We may withhold or suspend links when a workspace is under review for misuse. We cannot recall links or files after you have copied, downloaded or sent them.
9. Cancellations, refunds and regifting
- Before production. You can ask us to cancel a paid gift until it goes into production. A cancelled paid gift is refunded for its exact amount to the original payment method. Once production has started, a gift cannot be cancelled.
- Unused prepaid gifts. While a prepaid gift has not been claimed, including after its link expires, you can regift it to a different recipient yourself or request a refund. Regifting keeps the purchase, changes the recipient and replaces the old link.
- Declined gifts. If a recipient declines a prepaid gift, it can be refunded but not regifted.
- Staff review. Our staff review every refund request. If we decline a request, we tell you why. You can follow the status of each request in the campaign. Refunds go back to the original payment method and are complete once Stripe confirms them.
10. AI-assisted suggestions
Some features suggest gift notes, gift ideas or other text using artificial intelligence, and connected AI assistants may generate their own suggestions. Suggestions can be inaccurate, incomplete or inappropriate for a recipient. Review and edit them before you use them. You are responsible for the notes, messages and choices you approve.
11. ChatGPT, Claude and other connected tools
Connecting GTM Swag to ChatGPT, Claude or another tool is optional. When you connect, you choose which permissions to grant, and you can disconnect at any time from gtmswag.com/chatgpt/oauth/disconnect (ChatGPT) or gtmswag.com/oauth/disconnect (other assistants). Those tools are provided by other companies, and your use of them is also governed by their terms and privacy policies. Information you send to GTM Swag through them, and information GTM Swag returns to them, is handled by those providers under their own terms. We are not responsible for how a third-party tool behaves.
12. Acceptable use
You agree not to:
- use GTM Swag for anything unlawful, harassing, deceptive, discriminatory or harmful, or to send anything a recipient has asked not to receive;
- upload information you have no right to share, or impersonate another person or company;
- get around human review, payment, permission, rate or security controls, including by using another tool, account or automation to act on someone else’s behalf without their approval;
- probe or scan GTM Swag for vulnerabilities without our written permission, access another workspace’s data, or interfere with the service;
- copy, resell or scrape the service or catalog, or use it to build a competing product.
13. Your content and our license to use it
You keep ownership of the content you provide, including recipient lists, notes, messages, logos, artwork and photos. You grant Better Swag a limited, non-exclusive license to host, copy, process, adapt, print and display that content only as needed to provide, secure and support GTM Swag for you, including sharing it with the suppliers and carriers that produce and deliver your gifts. We do not sell your content.
14. Our intellectual property
GTM Swag, its software, catalog content, design and brand belong to Better Swag or its licensors. These terms do not give you any right to them except to use the service as described here. If you send us feedback, we may use it without obligation to you.
15. Disclaimers
To the fullest extent the law allows, GTM Swag is provided “as is” and “as available”. Better Swag disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted or error-free, that a gift will produce a reply, meeting or sale, or that reports and suggestions will be accurate.
16. Limitation of liability
To the fullest extent the law allows, Better Swag will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business or data. Our total liability for any claim relating to GTM Swag is limited to the amount you paid us for the gifts or services giving rise to the claim in the 12 months before the claim arose. Some jurisdictions do not allow these limits, so they may not apply to you in full.
17. Indemnity
You will defend and indemnify Better Swag against third-party claims arising from content or recipient information you provide, the messages you send, or your breach of these terms or of the law.
18. Suspension and termination
You may stop using GTM Swag at any time and ask us to close your account by contacting support. We may suspend or end access to a workspace, an API key, a connection or its gift links if we reasonably believe it is being misused, puts recipients or the service at risk, or breaks these terms or the law. Paid orders already in production may still be completed. Sections that by their nature should survive, including those on payment, your content, disclaimers, liability and indemnity, survive termination.
19. Governing law
These terms are governed by the laws of the state where Better Swag is organized, and applicable United States federal law, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in that state, unless the law requires otherwise.
20. Changes to these terms
We may update these terms as GTM Swag changes. We will post the new version on this page with a new effective date, and for material changes we will take reasonable steps to let workspace owners know. If you keep using GTM Swag after a change takes effect, the updated terms apply.
